A trademark attorney is a licensed lawyer who helps businesses and individuals choose, clear, file, and maintain trademarks with the United States Patent and Trademark Office. They advise on whether a name or logo is available, prepare the application, respond to the examining attorney's office actions, and track renewal deadlines. In our records an attorney appears when they are listed as the attorney of record on a filing.
What does a trademark attorney do?+
A trademark attorney typically runs a clearance search, files the application, and manages the back and forth with the USPTO until the mark registers or is refused. They also handle post-registration maintenance, such as the Section 8 and Section 9 filings, and can represent an owner in disputes like oppositions and cancellations. The specific work varies by matter, so the records here show only the filings where a given attorney was named.
Do I need a trademark attorney to register a trademark?+
If you are a US-domiciled applicant, you are allowed to file on your own. If your domicile is outside the United States, USPTO rules require you to be represented by a US-licensed attorney. Even when it is not required, many applicants use an attorney because clearance and office actions can be technical. This is general information, not legal advice.
Can I file a trademark without an attorney?+

Any attorney licensed and in good standing with a US state bar can represent an applicant before the USPTO for trademarks; a separate patent-bar admission is not required. That said, trademark practice has its own rules and deadlines, so experience with USPTO filings matters. A represented applicant must name a qualifying US-licensed attorney. How much does a trademark attorney cost?+
Attorney fees for trademark work vary by firm, location, and how complex the matter is, and many attorneys charge a flat fee per class while others bill hourly. Separate from the attorney fee, the USPTO charges its own government filing fee for each class of goods or services. Because pricing depends on the specific attorney and matter, we do not publish individual rates. Ask any attorney for a written fee estimate before you engage them.

What is a trademark registration?+
A federal trademark registration is a right granted by the USPTO that helps protect a brand name, logo, or slogan used in commerce. It gives the owner nationwide notice and legal advantages when enforcing the mark. Registration is not automatic; the USPTO examines each application and can refuse it. Our records show the status of each filing, such as live, pending, or dead.
